Property Tax Addendum

The Abode Property Tax Addendum (the “Property Tax Addendum”) is incorporated into the Terms of Service (the “Agreement”) between you and Abode. All capitalized terms used and not defined herein shall have the meanings ascribed in the Agreement. BY ACCESSING THE SERVICES, YOU HAVE AGREED TO BE BOUND BY THE AGREEMENT AND THE PROPERTY TAX ADDENDUM. PLEASE READ THE TERMS OF SERVICE AND PROPERTY TAX ADDENDUM CAREFULLY.

  1. PREAMBLE. As part of the Services, Abode may assist you in managing expenses related to homeownership, including without limitation by (a) providing you with third-party materials, including comparable appraisals, applicable forms, filing fee information, and deadlines, and mailing such forms and materials to local and state tax authorities at your direction, (b) acting as your unlicensed limited agent for the purpose of appealing your property taxes where allowable by law, (c) monitoring your property tax assessments, and/or (d) facilitating your representation by or connecting you with a third-party tax consultant or other licensed professional for the purposes of appealing property tax assessments. This Addendum applies to you to the extent that you access the Services for the purpose of lowering your property tax assessment. Services may vary by product and state.
  1. AUTHORIZATION.
    1. You authorize Abode to send tax protest forms signed by you, third-party comparable appraisals, other evidence provided to you by Abode, and other information provided by you to Abode to relevant local and/or state taxing authorities.
    2. If you access the Services for the purpose of Abode acting as your unlicensed limited agent, Abode appointing a third-party tax consultant or other licensed professional for you, or for the purposes of Abode connecting you with a third-party tax consultant or other licensed professional, you authorize Abode and/or the third-party tax consultant or other licensed professional to attempt to lower your property tax assessment on your behalf. YOU GRANT ABODE AND/OR SUCH TAX CONSULTANT OR LICENSED PROFESSIONAL THE AUTHORITY TO ACT AS YOUR PROPERTY MANAGER AND/OR AGENT FOR THE PURPOSES DESCRIBED HERE AND IN THE AGREEMENT. ANY AUTHORITY EXTENDED TO ABODE OR SUCH TAX CONSULTANT OR LICENSED PROFESSIONAL DOES NOT INCLUDE ANY OTHER PROPERTY MANAGEMENT DUTIES.
    3. The authorization is confined to activities performed for the purpose of obtaining a lower property tax assessment from the relevant government agency or tax office, including but not limited to: i) obtaining information about you, your property, and your property tax from relevant property tax assessment or appraisal authorities; ii) evaluation of your property tax assessment for errors and available exemptions, iii) performance of a comparative market analysis, iv) preparing and filing on your behalf and with the applicable government agency or tax office evidence supporting a property reduction, vi) appealing your property tax assessment, vIi) representing you at related appeal hearings, vIii) negotiating a reduction of your property tax with the relevant government agency or tax office, viii) monitoring of future assessments for appeal, and ix) assistance with future property tax appeals. The authorization does not include providing support to you in any binding arbitration or representing you in any appeal to a state or federal court. To the extent that any of the activities described in this subsection may be performed by a non-licensed actor, you authorize Abode to perform such activities.
    4. As part of the Services described at Subsection 2.2 above, you grant Abode the authority to appoint a tax consultant or other licensed professional as the agent for you and the applicable property and to do so by executing and submitting to applicable authorities an “Appointment of Agent” form (or any similar agent authorization forms required by the relevant property tax assessment or appraisal authorities, including a revocation of any previous property tax agent) on your behalf, including without limitation as your “property manager” or the "other person authorized to act on behalf of the owner other than the person being designated as agent”.
  1. SERVICES. Pursuant to the Agreement and Sections 1 and 2 of the Property Tax Addendum above, Abode or a third-party tax consultant or other licensed professional acting as your agent may:
  • Perform an analysis of your property tax assessment for accuracy and available exemptions;
  • Prepare and file evidence supporting a reduction of your property tax assessment;
  • Represent you at applicable hearings in relation to filings described above; and
  • Monitor on an on-going basis future yearly assessments and continue to provide the Services described above.
  1. PAYMENT. Pursuant to the Addendum, Charges for the Services may be calculated and charged to you as either a flat fee, subscription fee, or a Success Fee expressed as a percentage of the difference between your property tax bill for the specified year and the lowered property bill achieved for the same year, if any, as a result of the Services.
  • Success Fee. If a lower property tax assessment is successfully obtained, you will be charged a Success Fee of 25% of the first year’s savings.
  • You will not be charged a fee unless your property tax bill is reduced.
    Flat Fee. You have chosen to be charged a $79 annual fee (per property). This non-refundable fee will be automatically charged each year to your payment method on file, unless you cancel in advance.
  1. REGULATORY. Pursuant to the Agreement, Abode partners with third-party partners, including but not limited to licensed tax consultants. ABODE IS NOT A LICENSED PROPERTY ASSESSOR, APPRAISER, LEGAL ADVISOR, ATTORNEY, CERTIFIED ACCOUNTANT, OR TAX CONSULTANT. Abode does not provide any services deemed to be legal, advisory, or brokered services nor is Abode licensed by any state for these purposes. To the extent any such services are described in the Agreement or herein, they shall be provided only by licensed third-party tax consultants or other third-party professionals. 
  1. DISCLAIMERS. PURSUANT TO THE TERMS OF THE AGREEMENT, ABODE DOES NOT GUARANTEE OR WARRANT THAT YOUR USE OF THE SERVICES WILL RESULT IN A LOWERED TAX ASSESSMENT.
  1. TERM AND TERMINATION. This Property Tax Addendum auto-renews on an annual basis and may be terminated pursuant to the terms of the Agreement. Notwithstanding Section 14 of the Agreement, cancellations occurring within 30 days of the county’s official submission deadline for the year in which the services are being provided will be subject to a $50 cancellation fee payable to Abode.
  2. POWER OF ATTORNEY. For the purposes of Abode acting as your unlicensed limited agent in the state of Florida, you authorize Abode to receive and inspect confidential tax information and to perform any and all acts that you can perform with respect to the tax matters described above (for example, the authority to sign any agreements, consents, or other documents). Except as otherwise provided, the authority specifically includes the power to execute waivers of restrictions on assessment or collection of deficiencies in tax, to execute consents extending the statutory period for assessment or claims for refund of taxes, and to execute closing agreements under section 213.21, Florida Statutes. This authority does not include the power to endorse or cash warrants, or the power to sign certain returns. You appoint Abode as your representative to act as your Florida reemployment tax agent before the Florida Department of Revenue on a continuing basis and to receive confidential information with respect to mailings, filings, and other tax matters related to the Florida reemployment assistance program law.

YOU HAVE AGREED TO BE BOUND BY THE AGREEMENT INCLUDING THE PROPERTY TAX ADDENDUM.
